These Terms of Service ("Terms") govern your access to and use of Instinct AI's website, applications, and services (the "Service"). By creating an account or using the Service you agree to these Terms. If you do not agree, do not use the Service.
1. Acceptance
You confirm you are at least 16 years old and have the authority to enter into these Terms personally or on behalf of an organization.
2. The Service
Instinct provides pre-publish predictive analysis, recommended edits, render workflows, and publishing tools for YouTube creators. The Service is currently in beta and features may change, be added, or be removed.
3. Eligibility & account responsibility
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately of any unauthorized use.
4. Acceptable use
- Do not upload content you do not have the rights to.
- Do not use the Service to harass, defame, or infringe on others.
- Do not attempt to scrape third-party platforms beyond the official APIs we expose.
- Do not resell, sublicense, or repackage Service output as a competing API.
- Do not reverse engineer, probe, or interfere with the Service or its infrastructure.
5. Your content & license
You retain ownership of the videos, scripts, and assets you upload ("Your Content"). You grant Instinct a worldwide, non-exclusive, royalty-free license to host, process, transcode, render, and display Your Content solely to provide the Service to you. We do not use Your Content to train foundation models.
6. Third-party services
The Service integrates with third-party platforms including YouTube and Google AI. Your use of those features is also bound by their respective terms. See our YouTube API Disclosure.
7. Fees
Early access is free. Paid tiers will be governed by the then-current pricing displayed at /pricing. We will notify you before any billing begins on your account.
8. Disclaimers
The Service is provided "as is" and "as available," without warranties of any kind. Predicted retention, viral scores, and recommended edits are forecasts — Instinct does not guarantee YouTube performance, monetization, or revenue outcomes.
9. Limitation of liability
To the maximum extent permitted by law, Instinct will not be liable for indirect, incidental, special, consequential, or punitive damages. Our total liability for any claim arising out of or relating to the Service will not exceed the amount you paid us in the 12 months preceding the event giving rise to the claim, or USD 100, whichever is greater.
10. Indemnification
You agree to indemnify and hold Instinct harmless from any claims arising out of Your Content or your violation of these Terms.
11. Termination
You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms or if continued provision becomes commercially unreasonable. Sections that by their nature should survive termination will survive.
12. Governing law
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law principles. Disputes will be resolved in the state or federal courts located in Delaware.
13. Changes
We may update these Terms as the Service evolves. Material changes will be posted here with an updated date. Continued use after a change constitutes acceptance.
